Terms and conditions for the purchase and use of Tickets ("these Terms and Conditions") to the World Athletics Championships Tokyo 25 ("Event") are set out as follows by the Local Organizing Committee of World Athletics Championships Tokyo 25 ("Committee"). A Ticket User who makes an application to purchase, receives, holds or uses Tickets will be deemed to have understood the content of and agreed to these Terms and Conditions.
Article 1. Definitions
The terms used in these Terms and Conditions shall have the following meanings or the meaning defined separately in these Terms and Conditions.
- (1)"Venue" means a location managed by the Committee where a Session is held and entry to which requires a Ticket.
- (2)"Official Ticket Vendor" means a third party business operator authorized by the Committee or WA to sell and provide Tickets to third parties.
- (3)"Official Ticket Box" means a point of sales where Tickets are sold and delivered by the Committee. Official Ticket Boxes will be located in the vicinity of the Venue during the Event period.
- (4)"Personal Information" means information regarding a living individual which can identify a specific individual.
- (5)"Session" means a sports event or cultural event during a specific period of time for which Tickets are to be issued, and includes preliminaries, finals, the opening ceremony, the closing ceremony, etc.
- (6)"Ticket" means a ticket for the Event issued by the Committee.
- (7)"Ticket Buyer" means a person who purchases a Ticket in accordance with the WCH Tokyo 25 Ticket Rules. For the avoidance of doubt, it includes a person who purchases a resale Ticket through the WCH Tokyo 25 Official Ticket Resale Service and does NOT include a person who has sold the purchased Tickets to a third party through the WCH Tokyo 25 Official Ticket Resale Service.
- (8)"Ticket Holder" means a person in legitimate possession of a Ticket, and includes persons who have received a Ticket from a Ticket Buyer or authorized third party in accordance with the WCH Tokyo 25 Ticket Rules.
- (9)"Ticket User" means Ticket Buyers and Ticket Holders collectively.
- (10)"WCH Tokyo 25 Ticket Rules" means, collectively, these Terms and Conditions, the Personal Information Protection Policy of the Committee, and other rules, conditions, bylaws or regulations separately provided by the Committee in relation with the Tickets and/or entry into and exit from the Venue.
- (11)"WCH Tokyo 25 Official Ticket Site" means the Ticket sale website of the Event which provides information on Tickets and opportunities to purchase Tickets directly from the Committee.
- (12)"WCH Tokyo 25 Official Ticket Resale Service" means the official online platform on which Ticket Buyers who have purchased a Ticket directly from the WCH Tokyo 25 Official Ticket Site may resell their Tickets.
- (13)"Force Majeure" means a natural disaster, outbreak of infectious disease, war, riot, revolt, civil commotion, terrorist attack, fire, explosion, flood, theft, damage caused by harmful intent, strike, access restriction, weather, injunctive act by a third party, emergency situation involving national defense or public health, act or regulation of the national or local government, and any other causes beyond the control of the Committee and/or Event Affiliates.
- (14)"Event Affiliate" means collectively WA, JAAF, each NF, and the Committee.
- (15)A "person" means an individual or a corporation, partnership or other person having legal personality.
- (16)"JAAF" means the Japan Association of Athletics Federations.
- (17)"NF" means the national athletics federation of each country or territory which is a member of WA and has oversight over athletics in each country.
- (18)"WA" means World Athletics.
Article 2. Scope of Application of the WCH Tokyo 25 Ticket Rules
Purchase and use of Tickets for the Event as well as entry and exit from the Venue must be in compliance with the WCH Tokyo 25 WA Ticket Rules, and Ticket Users' rights relating to the Tickets shall be limited to the extent recognized by the Committee under the WCH Tokyo 25 WA Ticket Rules.
Article 3. Amendment of the WCH Tokyo 25 Ticket Rules
- 1.The Committee may amend the WCH Tokyo 25 Ticket Rules at its discretion as necessary. If the WCH Tokyo 25 Ticket Rules are amended, the Committee shall announce the amendments and date of amendment in advance by publication on the WCH Tokyo 25 Official Ticket Site or by other method deemed appropriate by the Committee.
- 2.All reasonable amendments under Article 3.1 above either beneficial to the Ticket User or does not violate the purpose of the WCH Tokyo 25 Ticket Rules are deemed agreed and accepted by Ticket Users.
- 3.The most recent version of the WCH Tokyo 25 Ticket Rules can be accessed at the WCH Tokyo 25 Official Ticket Site.
Article 4. Content of Tickets
- 1.The ownership of all Tickets is vested in the Committee.
- 2.Ticket Holders may enter the Venue, spectate the Session, and use the seat or space specified by the Committee in accordance with the content of the Ticket and the WCH Tokyo 25 Ticket Rules.
- 3.Persons who are three years of age or older at the time of the Session must be a Ticket Holder. Persons under the age of three who do not use a seat may sit on the lap of an adult, up to one child per adult. If a person under the age of three uses a seat, the child must also be a Ticket Holder.
- 4.Tickets are issued by the Committee in accordance with the WCH Tokyo 25 Ticket Rules. The Ticket may be in the form of (1) a home printed Ticket where a Ticket issued as electronic data and printed out by the Ticket User, (2) an electronic Ticket issued through the electronic ticketing service specified by the Committee and displayed on the screen of a device, or (3) a Ticket issued by printing on paper (mainly as a same-day ticket).
- 5.Wheelchair seat tickets will be sold for each Session and at several price points. One caregiver may accompany one wheelchair seat Ticket Holder free of charge.
- 6.No refund or cancellation of Tickets will be accepted except as specifically provided in the WCH Tokyo 25 Ticket Rules or under laws and regulations. Tickets cannot be exchanged for a different type of Ticket, a Ticket for a different seat in the same Session, or for a Ticket for a different Session.
- 7.Except where permitted by the Committee, Tickets cannot be exchanged in case of loss, damage, theft, or inaccessibility on any device.
- 8.The number of Tickets which one person may purchase for one Session may be restricted. Whether such restrictions apply will be posted on the WCH Tokyo 25 Official Ticket Site; however, such information is subject to change.
Article 5. Purchase of Tickets
- 1.Tickets may be purchased from the WCH Tokyo 25 Official Ticket Site or from an Official Ticket Vendor, or, through the WCH Tokyo 25 Official Ticket Resale Service, or, during the Event period, from an Official Ticket Box.
- 2.In order to purchase Tickets directly from the Committee in advance, the necessary items must be filled in on the WCH Tokyo 25 Official Ticket Site. The WCH Tokyo 25 Official Ticket Site is used when purchasing Tickets from the Committee. When purchasing Tickets from an Official Ticket Vendor, the purchase application procedures stipulated by such Official Ticket Vendor shall apply.
- 3.A person who purchases Tickets must not manipulate, alter, modify, or damage or attempt to manipulate, alter, modify, or damage the WCH Tokyo 25 Official Ticket Site. The Committee may refuse a purchase of Tickets made by using a manipulated, altered, modified or damaged WCH Tokyo 25 Official Ticket Site. In such case, the Committee shall not be liable for such refusal of Ticket purchase.
- 4.Except as permitted by the Committee, a Ticket Buyer cannot change the content of or cancel a purchase after purchasing Tickets.
- 5.Please note that purchasing Tickets does not guarantee that entry into Japan will be granted.
Article 6. Malfunction when using the WCH Tokyo 25 Official Ticket Site
The Committee shall not be liable for the entry of mistaken, incomplete, or unreadable letters or symbols entered in the WCH Tokyo 25 Official Ticket Site, technical malfunction of the Internet, or a computer hardware or software malfunction interfering with the completion of the entering information into WCH Tokyo 25 Official Ticket Site.
Article 7. Change in Number of Sales, and Resumption of Sales
The total number of Tickets sold is determined by the Committee at its sole discretion and may be increased or decreased from time to time. The Committee reserves the right to terminate or resume Ticket sales at its discretion. Tickets that have already been purchased cannot be changed, cancelled, exchanged, or refunded, even if the total number of Tickets sold increases or decreases, or Ticket sales are suspended or resumed.
Article 8. Purchase of Tickets in Violation of WCH Tokyo 25 Ticket Rules
- 1.The Committee may, at its discretion, reject or cancel any of the following ticket purchase applications:
- (1)Purchase of Tickets made in violation of WCH Tokyo 25 Ticket Rules or laws and regulations;
- (2)Purchase of Tickets from persons who may resell, distribute, or provide tickets in violation of WCH Tokyo 25 Ticket Rules; or
- (3)Purchase of Tickets from persons who may have entered and submitted fraudulent or misleading information on the WCH Tokyo 25 Official Ticket Site.
- 2.Tickets can only be purchased from the Committee or Official Ticket Vendor, or through the WCH Tokyo 25 Official Ticket Resale Service. The Committee assumes no responsibility for Tickets purchased from parties other than the Official Ticket Vendor or purchased through resale without using the WCH Tokyo 25 Official Ticket Resale Service, may invalidate such tickets without refund, and may require the Ticket Holder to return the printed paper Tickets.
Article 9. Timing and Method of Payment
- 1.The Ticket Buyers who purchased tickets from the WCH Tokyo 25 Official Ticket Site are deemed to agree to pay for the Ticket by a method provided by the Committee, such as by credit card (meaning payment by credit card, debit card or prepaid card). The Committee will only charge the Ticket Buyer for Tickets purchased. Ticket Buyers must pay the price by the payment method provided by the Committee by the payment date provided by the Committee. When purchasing Tickets from an Official Ticket Vendor, the timing and method of payment shall be in accordance with as separately stipulated by the Official Ticket Vendor.
- 2.The Committee may, at its discretion, provide the details of the method of payment for Tickets purchased from the WCH Tokyo 25 Official Ticket Site.
- 3.In the event that a Ticket has been purchased but payment has not been received by the payment date provided by the Committee, the Committee reserves the right to invalidate the purchase upon expiration of the payment date. The Committee will not be liable for any damages to the Ticket Buyer or any third party as a result of the voiding of the purchase.
Article 10. Fee Burden
In addition to the face value of the Ticket, the Ticket Buyer who purchased Tickets from the WCH Tokyo 25 Official Ticket Site shall pay any and all fees incurred in connection with transactions with the Committee, such as Ticket issuance, payment and receiving procedures. Further, when purchasing Tickets from an Official Ticket Vendor, it shall be in accordance with the procedures stipulated by such Official Ticket Vendor.
Article 11. Designation of Seats
- 1.The Committee, at its discretion, will pre-assign to the pre-sales Ticket Buyer a seat or space for spectating the Session, according to the type of Ticket purchased. The Ticket Buyer cannot request a change in their designated seat or space.
- 2.In the event that the Committee deems it necessary for the operation of the Event, such as Venue set-up and safety, the Committee may, at its discretion, change the pre-assigned seating or space in any Venue or Session to a location of equal or greater value.
Article 12. Ticket Prices
The price of Tickets will be determined by the Committee in Japanese yen. Ticket prices are inclusive of tax (including consumption tax), but do not include the fees provided in Article 10 (Fee Burden) of these Terms and Conditions which are charged in addition to the price of the Ticket.
Article 13. Receipt of Tickets
- 1.The Committee will issue Tickets to Ticket Buyers upon confirmation of full payment for Tickets purchased through the WCH Tokyo 25 Official Ticket Site. The Committee may withhold the issuance of Tickets for which an application has been submitted until the Committee confirms the completion of payment of the price.
- 2.Ticket Buyer who purchased Tickets from the WCH Tokyo 25 Official Ticket Site shall select their preferred method of receipt from the following. The Committee may designate a separate method of receiving Tickets, if necessary.
- (1)Home-printed tickets where the Ticket Buyer prints out the ticket on a printer at home, etc.
- (2)Downloading electronic Tickets through an electronic ticketing service designated by the Committee (to be received on a device)
- 3.Regardless of the method of receipt, no reproduction or duplication of the Ticket may be provided to a third party. Ticket Buyers who provide a reproduction or a duplicate of a Ticket to a third party violate the WCH Tokyo 25 Ticket Rules, and the Committee reserves the right to invalidate all Tickets purchased without refund.
- 4.The Committee is not responsible for Tickets not received or delayed except for reasons attributable to the Committee.
- 5.When purchasing Tickets from an Official Ticket Vendor, it shall be in accordance with the procedures stipulated by such Official Ticket Vendor.
Article 14. Obligation of Ticket Holder
- 1.The Ticket Holder understands and agrees that there may be risks involved in spectating the Session, such as heat stroke, coronavirus disease and other infectious diseases, etc.
- 2.The Ticket Holder is responsible for the safety of him/herself and any accompanying children, and safety of their property.
- 3.The Ticket Holder is responsible for the conduct of the accompanying children and their compliance with the WCH Tokyo 25 Ticket Rules.
- 4.Ticket Holders shall comply with all health and safety regulations issued by the Committee, all directives of the Ministry of Health, Labor and Welfare and the Tokyo Metropolitan Government, and all applicable laws and regulations. This includes screening, testing, vaccination and other provisions for infectious diseases.
Article 15. Spectating
- 1.Please allow plenty of time to arrive before the Session start time, taking into account the time required to travel to the Venue and security screening. Depending on the level of congestion, it may take some time before a Ticket Holder can enter the Venue due to security inspections and ticket confirmation. If a Ticket Holder arrives late to the Venue for reasons other than those attributable to the Committee, such as personal reasons or transportation delays, the Committee will not refund the Ticket.
- 2.The Committee reserves the right to restrict or delay entry of Ticket Holders for reasons of Event operations and securities, such as if the preceding Session is not completed on schedule. The Committee will not be liable for any disadvantage to the Ticket Holder caused by such entry restrictions or delays, and will not exchange or refund Tickets.
Article 16. Entry
- 1.Ticket Holders must present a valid Ticket to the Venue staff in order to enter the Venue and spectate the Sessions. Subject to Article 4.3 all accompanying children must be Ticket Holders.
- 2.Ticket Holders must respond to requests from Committee staff, Venue attendants, police officers, etc. to verify their identity or to confirm that they are in possession of such Tickets in accordance with the WCH Tokyo 25 Ticket Rules.
Article 17. Security Inspection
- 1.The Committee conducts security inspections on Ticket Holders and their personal belongings to ensure their safety and smooth implementation of the Event at the Session when entering and after entering, as necessary. In addition, if requested by the Committee, Ticket Holders must cooperate with the Committee in the provision of identification, etc.
- 2.If a Ticket Holder refuses to cooperate with security inspections, he/she will not be allowed to enter the Venue, and if he/she has already entered, they will be required to leave immediately. In such cases, no refund will be made towards the Ticket held by the Ticket Holder.
Article 18. No Re-entry
Unless otherwise authorized by the Committee, Ticket Holders who leave the Venue will not be allowed to re-enter with the same Ticket.
Article 19. Possession of Valid Tickets
- 1.Ticket Holders must keep their Tickets in their possession at all times from the time Ticket Holders enter the Venue until the time they leave, and must present their Tickets when asked to do so by Committee staff, Venue attendants, or police officers. Failure to present the Ticket may result in the Ticket Holder's removal from the Venue.
- 2.Any person who enters the Venue using a Ticket obtained in violation of the WCH Tokyo 25 Ticket Rules will be subject to removal from the Venue by the Committee, as well as further legal action.
Article 20. Prohibited Items
- 1.The Committee may determine prohibited items that Ticket Holders cannot bring into the Venue. Ticket Holders are not permitted to enter the Venue with any item in their possession that violates such prohibitions. If a Ticket Holder is found to be in possession of a prohibited item at the Venue, he/she may be required to immediately relinquish the item or leave the Venue. If the Committee discovers that a Ticket Holder is in possession of an item that violates laws or regulations, the Committee will notify the relevant authorities.
- 2.The list of prohibited items will be established by the Committee in a timely manner and will also be attached to the WCH Tokyo 25 Ticket Rules. The Committee may change the contents of such list of prohibited items, and may also specify prohibited items for particular Sessions.
Article 21. Prohibited Acts
If a Ticket Holder is found to have committed any of the following acts, the Committee may, at its discretion, refuse entry to the Venue or ask the Ticket Holder to leave the Venue. In such cases, no refund will be made for the Ticket held by the Ticket Holder. A more precise list of prohibited acts will be established by the Committee in a timely manner and will also be attached to the WCH Tokyo 25 Ticket Rules. The Committee may change the contents of such prohibited acts, and may also specify prohibited acts for particular Sessions.
- .Any act that may interfere with the conduct of the Session
- .Any act that may interfere with the spectating of the Session
- .Any act that may cause damage to life, body, or property
- .Any act that may harm or interfere with the management and operation of the Venue
- .Any act that may be regarded as eambushf marketing that is prohibited under Article 30 (Prohibition of Use for Promotional Purposes), or any other act that may harm the rights of the Event including the WA's and Committeefs sponsors
- .Any act that is in violation of laws and regulations
- .Any act that is in violation of WCH Tokyo 25 Ticket Rules
- .Other prohibited acts as determined by the Committee from time to time
Article 22. Photography/Filming
- 1.Please note that the Sessions are public events and that the manner and behavior of the Ticket Holder in and around the Venue where the Session is held is inherently public, and that privacy regarding the behavior of the Ticket Holder during the Session cannot be guaranteed.
- 2.The Ticket Holder and any other persons attending the Event agree to be photographed, filmed, identified, and recorded by any other method by the Committee, WA, or any third party authorized by the Committee or WA. In addition, the Ticket Holder and any other persons attending the Event agree that the Committee, WA, or any third party authorized by the Committee or WA may use still images, videos, recordings, etc. that include the voice, image, and likeness of the Ticket Holder or any other person attending the Event, in perpetuity, for commercial purposes or otherwise, in live or recorded video displays, broadcasts, streaming, uploading, posting or other transmission or recording, photographs, or in any other media technologies existing now or in the future, free of charge or any compensation.
- 3.Ticket Holders may take photographs or record videos of the Event for private and non-commercial use only. However, this may be restricted in some areas or Sessions.
- 4.Ticket Holder may record, upload, post, or transmit any audio, still image, video, data, description, or results of the Event, in whole or a part of the Event, for his/her private and non-commercial use only. However, unless authorized in writing by WA, it is strictly prohibited to upload, post, send, or otherwise disseminate audio, still images, video, data, descriptions, results and statistics of the Event, in whole or in part, via the Internet, radio, television or any other current or future media, or engage in any activity which supports others who commit such acts for the purpose of any sort of public access, advertising, gambling, or any other commercial purpose.
Article 23. Prohibition of Resale
- 1.Ticket Holder may not resell Tickets to third parties, and may not offer or advertise Ticket resale on the Internet, in newspapers, ticket stores, or any other place or media, except when specifically authorized by the Committee or WA or as provided in Article 24 (Exception to the Prohibition of Resale). The Ticket Holder may not offer Tickets to third parties together with or as part of other goods or services, unless specifically authorized by Committee, WA, or the WCH Tokyo 25 Ticket Rules. This includes the act of transferring the rights recognized or represented by the Ticket to a third party, such as providing Ticket information like the QR code of the Ticket or transferring the WCH Tokyo 25 Ticket ID to a third party.
- 2.Tickets sold, offered for sale or advertised in violation of the WCH Tokyo 25 Ticket Rules will be invalid and cancelled. The Committee may request the return of Tickets that are invalid. Invalid Tickets will not be exchanged or refunded.
- 3.Unless specifically authorized under Article 24 (Exception to the Prohibition of Resale), Tickets may not be purchased from persons other than the Official Ticket Vendors. The Committee assumes no responsibility for Tickets purchased from parties other than Official Ticket Vendor or purchased through resale without using the WCH Tokyo 25 Official Ticket Resale Service.
- 4.In order to prevent unauthorized resale, all Ticket Holders agree in advance to the following.
- (1) If the Committee discovers that Tickets are being sold, offered for sale or advertised by a third party (including retailers and online shops), the Committee may ask the third party to disclose the contents of the Ticket and the Personal Information of the Ticket Holder who sold the Ticket, and the Ticket Holder may not make an objection to such disclosure against the Committee or the third party.
- (2) If the Committee discovers that Tickets are being sold, offered for sale, or advertised on a ticket resale site, online auction, online flea market, social media, other online services, or other services, the Committee may (i) request the service provider to disclose the contents of the Ticket and the Personal Information of the Ticket Holder who sold, offered for sale, or advertised the Ticket, and (ii) request, on behalf of the Ticket Holder, that the service provider cease providing the Ticket and to cease posting information regarding the Ticket. The Ticket Holder may not make an objection against the Committee or the service provider with respect to such disclosure of information, suspension of Ticket sales or suspension of posting of Ticket information.
- 5.Unauthorized resale of a Ticket may be subject to criminal penalties, and the Committee will report such resale, offer to sell or advertisement to the police upon discovery immediately.
Article 24. Exception to the Prohibition of Resale
- 1.Transfer of Tickets purchased directly from the Committee to a third party is only permitted for resale at the purchase price using the WCH Tokyo 25 Official Ticket Resale Service. The transfer of the Tickets purchased from an Official Ticket Vendor to a third party shall be in accordance with the procedures stipulated by such Official Ticket Vendor.
- 2.The Committee may verify the identity of the Ticket Holder at the Venue entrance or inside the Venue or confirm that Ticket Holders are in possession of their Tickets in accordance with the WCH Tokyo 25 Ticket Rules. If the identity of the Ticket Holder cannot be verified, or if it is determined by the Committee that the Ticket Holder is not a person authorized to hold the Ticket, that person may be asked to leave the Venue.
Article 25. Change in Event Scheduling
- 1.The Event and Sessionfs scheduling may be moved up, delayed, cancelled, suspended, or postponed at the discretion of the Committee without notice due to weather, Event management conditions, safety assurance, or Force Majeure. The Committee shall not be liable for any losses incurred by Ticket Users resulting from changes in the Eventfs scheduling, except as specified in the WCH Tokyo 25 Ticket Rules.
- 2.The Ticket User understands and agrees that all travel plans and arrangements are the Ticket Users sole responsibility, including airfare and hotel reservations, are subject to the possibility of changes to the Event and its Sessions under Article 25.1, and that the schedule and order of competition may differ from those previously scheduled.
- 3.In the event of postponement of the Event and Sessions, the Committee will, at its sole discretion, determine whether any Tickets will be refunded.
Article 26. Cancellation of Event and Refunds
In the event of cancellation of the Event and Sessions, the Ticket Buyer will be granted a refund in accordance with WCH Tokyo 25 Ticket Rules.
Article 27. Subject of Refund
- 1.In the event of cancellation of the Event due to any reason stated in the WCH Tokyo 25 Ticket Rules, Ticket Buyers may receive a refund up to the face value of the Ticket. If a Ticket refund is granted, the Committee will refund the face value of the Ticket to the Ticket Buyer in accordance with the WCH Tokyo 25 Ticket Rules and other proceedings determined by the Committee. Various fees (including the fees provided at Article 10 (Fee Burden)) are not subject to refund. Ticket refunds are the sole Remedy and no exchanges, changes, cancellations or returns of Tickets will be permitted.
- 2.Ticket refunds will only be made to the Ticket Buyer who purchased Tickets directly from the Committee or purchased resale Tickets through the WCH Tokyo 25 Official Ticket Resale Service. Ticket Holders who are not a Ticket Buyer are not eligible for refunds. In addition, Ticket Buyers who purchased Tickets from Official Ticket Vendors are not eligible to receive refunds directly from the Committee.
Article 28. Method of Refund
If a Ticket Buyer is entitled to a refund from the Committee, the Ticket Buyer must apply for the refund on the WCH Tokyo 25 Official Ticket Site by the date specified by the Committee. When applying for a refund, at least the type and number of Tickets subject to be refunded must be specified. Details will be determined by the Committee, and posted on the WCH Tokyo 25 Official Ticket Site at the appropriate time.
Article 29. Limitations to the Number of Event Participants
In the event of Force Majeure, the Committee may limit the number of participants for this Event. In such cases, the Committee will determine the Venue's capacity and seating configuration, and the handling of Tickets that the participation is limited will be separately determined in the WCH Tokyo 25 Ticket Rules.
Article 30. Prohibition of Use for Promotional Purposes
- 1.Tickets may not be used for advertising, sales, PR, auction, promotions or other marketing purposes (including in connection with an event, advertisement, contest or offering as a reward, or including as part of a hospitality or travel package), with or without commercial benefit, except as contractually permitted by the Committee, WA or a third party authorized by the Committee or WA.
- 2.Except as contractually permitted by the WA or a third party authorized by the WA, no person may transfer, use, or otherwise dispose of the Ticket in any manner that would lead to be believed that they sponsor or are associated with the Event or any part of the Event.
- 3.Unless expressly authorized in writing by WA, Ticket Users are strictly prohibited from using, wearing, possessing, distributing or holding items for promotional or commercial purposes or from selling or offering to sell of any beverage, food, souvenir, clothing, or other items in any Venue. All such items may be removed or confiscated by the Committee without compensation to the Ticket User.
Article 31. Compliance with Personal Information Protection Policy
Ticket User agrees that his/her Personal Information submitted to the Committee will be processed in accordance with the Committee's "Personal Information Protection Policy". In addition, the Ticket User shall agree that his/her Personal Information submitted to the Committee will be shared with WA for business analytics purposes and marketing purposes, (this includes purchasers of Tickets from a Ticket Buyer through the WCH Tokyo 25 Official Ticket Resale Service) and will be stored in accordance with WA's personal information protection policy and the Committee's "Personal Information Protection Policy". Ticket User also agrees that images and recordings taken by Sony (an official sponsor of the Event) will be used for non-commercial purposes (i.e. to communicate the Sonyfs association with WA and the Event) and held in accordance with its privacy policy. Article 32. Exclusion of Antisocial Forces
If the person who intends to purchase a Ticket, person applied for the Ticket, Ticket Buyer, or Ticket Holder is determined by the Committee to be related to a criminal organization, a member of a criminal organization, an associate member of a criminal organization, a company related to a criminal organization, a corporate racketeer (sokaiya) that threatens or interferes with a general meeting of shareholders, an activist who seeks to gain illegal profits by posing as a social activist, an activist who seeks to gain illegal profits by posing as a a political activist, or a criminal organization-related group, similar group, or individual with expertise (so-called antisocial forces), the Committee will refuse to sell or deliver Tickets to such a person, refuse admission to the Venue and spectating of the Event, or order such a person to leave the Venue.
Article 33. Invalid Ticket
Any Ticket acquired, transferred, resold or used in advertising in violation of the WCH Tokyo 25 Ticket Rules shall become void without refund and all rights granted or represented by such Ticket shall cease to be valid. The invalid Ticket will not allow the Ticket Holder to enter the Venue and to spectate the Event.
Article 34. Exemption from Liability
- 1.The Committee, Official Ticket Vendor and Event Affiliates shall not be liable for loss, theft, damage or defacement of Tickets, and the Committee will not reissue Tickets in case of such loss, theft, damage or defacement.
- 2.The Event cannot be viewed and entry into the Venue cannot be gained with a forged Ticket or invalid Ticket, and the Committee shall not be liable in relation with the acquisition of forged Tickets or invalid Tickets.
- 3.Ticket Holders are responsible for making their own arrangements for transportation, accommodation, food and drink for spectating the Event, and the Committee, Official Ticket Vendors and Event Affiliates shall not be liable in relation with the same.
- 4.The Committee will provide first aid to the extent possible in the event of illness or injury during the Event, but except in cases of willful misconduct or gross negligence, the Committee shall not be responsible for the content or results of the treatment.
- 5.The Committee, Official Ticket Vendor, owner and manager of the Venue, other contractors of the Committee, the sponsor of WA, the sponsor of the Committee, the Eventfs commercial affiliates or Event Affiliates involved in the operation of the Event shall not be liable for damage incurred by Ticket Holders while spectating a Session, except where such damage is caused by reasons directly attributable to them. This exemption from liability includes:
- (1) damage resulting from the appropriate conduct of the Event;
- (2) damage resulting from acts of the Ticket User in violation of the WCH Tokyo 25 Ticket Rules; and
- (3) damage resulting from a Force Majeure.
Article 35. Force Majeure
The Committee shall not be liable for inability to perform its obligations under the WCH Tokyo 25 Ticket Rules if such inability is caused by a Force Majeure.
Article 36. Limitation of Liability
If a Ticket User incurs damage due to a violation of the WCH Tokyo 25 Ticket Rules by the Committee or the Official Ticket Vendor, to the extent permissible under laws and regulations, the liability of the Committee for such damage shall not exceed the total amount of the face value of the Tickets purchased or held by the Ticket User. Further, the Committee, Official Ticket Vendor, the Event Affiliates, the sponsor of WA, the sponsor of the Committee and/or Event commercial affiliates shall not be liable for any special damage, indirect damage, or consequential damage incurred by the Ticket User as a result of the Committee or Official Ticket Vendor's violation of the WCH Tokyo 25 Ticket Rules; provided, however, that this limitation shall not apply in case of willful misconduct or gross negligence by the Committee, Official Ticket Vendor, the Event Affiliates, the sponsor of WA, the sponsor of the Committee and/or Event commercial affiliates in relation with such violation.
Article 37. Effectiveness of Surviving Provisionsj
Even if any provision of the WCH Tokyo 25 Ticket Rules becomes invalid for any reason, the other provisions shall continue to remain in effect.
Article 38. Language
These Terms and Conditions are prepared in the Japanese language. If there is any discrepancy between the Japanese version of these Terms and Conditions and the translation into English or other languages provided by the Committee or Official Ticket Vendor, the provisions of the Japanese version shall always prevail.
Article 39. Governing Law and Jurisdiction
- 1.The WCH Tokyo 25 Ticket Rules shall governed by and construed in accordance with the laws of Japan.
- 2.Any dispute arising between the Committee and a Ticket User regarding the Tickets or the WCH Tokyo 25 Ticket Rules shall be resolved upon discussion in good faith between the parties.
- 3.In the case of Article 38.2 above, if a resolution cannot be reached through discussion, the Tokyo District Court shall have exclusive jurisdiction in the first instance over such dispute.
